1. Introduction
These Terms and Conditions govern your use of the Excell RE website and learning platform ("the Platform"). By accessing the Platform, registering an account, or subscribing to any plan, you agree to be bound by these terms. If you do not agree, please do not use the Platform.
2. Who we are
Excell RE is an independent tutoring and exam-preparation service operated by Flournish Holdings. Our contact email is excellreexam@gmail.com. We are not an examination body and are not affiliated with, endorsed by, or acting on behalf of Moonstone, the FSCA, or any other official regulator.
3. What we provide
The Platform provides learning resources, lessons, study notes, practice questions, mock examinations, performance analytics, flashcards, and an AI-powered study assistant. All content is intended for educational preparation only and does not constitute legal, financial, or professional advice.
4. What we do not provide
We do not register candidates for official regulatory examinations, process examination bookings, or collect official examination fees. You are responsible for registering directly with the official examination body, currently Moonstone, and for complying with its registration rules, deadlines, and identification requirements.
5. Accounts and access
You must provide accurate information when creating an account. You are responsible for keeping your login credentials secure. We reserve the right to suspend or terminate accounts used in violation of these terms, including sharing access or using the Platform for unlawful purposes.
6. Subscriptions and payments
Subscription plans are billed as advertised at the time of purchase. Monthly plans renew every month; standard plans cover a six-month period; annual plans cover a twelve-month period. All fees are payable in South African Rand unless otherwise stated. You may cancel your subscription at any time, but fees already paid are not refundable unless required by law or otherwise stated in our refund policy.
7. Intellectual property
All content, code, designs, and materials on the Platform are owned by or licensed to Excell RE. You may access content for personal study use only. You may not copy, distribute, sell, scrape, download for redistribution, or otherwise exploit Platform content without written permission.
8. Acceptable use
You agree not to misuse the Platform, including attempting to bypass security, interfere with other users, extract data automatically, or upload harmful code. The AI Study Buddy is provided as a learning aid; you should always verify legislative references against the official source.
9. Results and outcomes
We do not guarantee that use of the Platform will result in a pass in any official examination. Your success depends on your own effort, preparation, and the official examination process. We are not liable for any decision, outcome, or cost arising from an official examination result.
10. Limitation of liability
To the fullest extent permitted by South African law, Excell RE and its operators shall not be liable for any indirect, consequential, or special damages arising from your use of the Platform. Our total liability for any claim relating to the Platform shall not exceed the amount you paid for the current subscription period.
11. Changes to terms
We may update these Terms and Conditions from time to time. Material changes will be posted on this page with a revised date. Continued use of the Platform after changes constitutes acceptance of the updated terms.
12. Governing law
These terms are governed by the laws of the Republic of South Africa. Any dispute arising from these terms shall be resolved in the courts of South Africa.
