This Privacy Policy is maintained by Flournish Holdings to explain how Excell RE (“we”, “us” or “the Platform”) collects, uses, stores, shares and protects your personal information. It is written to help us comply with the Protection of Personal Information Act, 2013 (“POPIA”).

By using the Platform, creating an account or subscribing to a plan, you consent to the practices described in this policy. If you do not agree, please do not use the Platform.

3. What information we collect

We only collect personal information that is reasonably necessary to provide our services. This may include:

• Identity and contact information: name, email address, phone number, and any other information you provide when registering.
• Account information: username, password hash, role, and subscription status.
• Payment information: billing records, transaction references, and payment status processed by our payment provider. We do not store full credit card or bank details on our servers.
• Learning data: exam selections, study progress, quiz and mock-exam results, completed topics, flashcards, bookmarks, AI Study Buddy conversations, and performance analytics.
• Technical information: IP address, browser type, device information, operating system, and cookies or similar technologies used to keep you signed in and understand how the Platform is used.
• Communications: emails, messages, support requests, and feedback you send us.

4. How we use your information

We use your personal information for the following purposes:

• to create and manage your account and provide access to your subscribed courses;
• to process payments, subscriptions, and renewals;
• to personalise your study plan, track progress, and generate performance insights;
• to power the AI Study Buddy and provide learning assistance;
• to communicate with you about your account, updates, support, and marketing where you have consented;
• to maintain security, prevent fraud, and enforce our Terms and Conditions;
• to comply with applicable laws, regulations, and lawful requests.

5. Legal basis for processing

Under POPIA we process personal information based on one or more of the following grounds: your consent, the performance of a contract with you, our legitimate interest in operating and improving the Platform, or compliance with a legal obligation. Sensitive information is only processed when you have given explicit consent or the law permits it.

6. How we share information

We do not sell your personal information. We share it only with trusted service providers who help us run the Platform, and only to the extent necessary for them to perform their functions. These currently include:

• Lovable Cloud / Supabase — hosting, database, authentication, and storage infrastructure.
• Paystack — payment processing and transaction verification.
• AI gateway providers — used to generate answers, hints, and flashcards in the AI Study Buddy. Your prompts are sent to these providers for processing, and we do not use them to train third-party models.

We may also disclose information if required by law, to protect our rights or the safety of users, or as part of a business transfer.

7. Where information is stored

Your personal information is stored in secure cloud infrastructure managed by Lovable Cloud / Supabase. Data may be processed and stored in data centres outside South Africa. Where this happens, we rely on appropriate contractual safeguards and the security measures provided by the platform, including encryption in transit.

8. Security

We protect your information using reasonable technical and organisational measures, including encryption in transit, role-based access controls, secure authentication, and regular access reviews. No system is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account password and login details confidential.

9. How long we keep information

We keep your personal information for as long as your account is active or as needed to provide the service. After account closure:

• learning progress, quiz results, and AI Study Buddy history are retained for up to 3 years of inactivity unless you ask us to delete them earlier;
• payment and transaction records are retained for up to 5 years to meet tax, accounting, and legal record-keeping obligations;
• account identifiers may be retained in anonymised or aggregated form for analytics and security purposes.

10. Your POPIA rights

You have the right to:

• request access to the personal information we hold about you;
• request correction, updating, or deletion of your personal information;
• object to processing for direct marketing purposes;
• withdraw consent where processing is based on consent;
• lodge a complaint with the Information Regulator of South Africa if you believe your rights have been violated.

11. Cookies and tracking

We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the Platform is used. You can control cookies through your browser settings. Some cookies are necessary for the Platform to function and cannot be disabled without affecting your experience.

12. Children

The Platform is intended for users who are 18 years or older, or who have the consent of a parent or guardian. We do not knowingly collect personal information from children under the age of 18 without appropriate consent. If you believe we have collected information from a child without proper consent, please contact us.

13. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with a revised date. Where required by law, we will notify you of significant changes. Continued use of the Platform after changes constitutes acceptance of the updated policy.
